POLITIKA E PRIVATËSISË

Kjo politikë shërben për të informuar se si përpunohet kur grumbullohet dhe ruhet DHP (të dhënat personale) si pjesë e nevojshme e proceseve të punës dhe kushteve të bashkëpunimit në kompaninë TV Klan.

Kjo politikë është hartuar në zbatim të detyrimeve të ligjit nr.124/2024 “Për mbrojtjen e të dhënave personale” dhe akteve nënligjore të dala në zbatim të tij.

Si e përdor TV Klan informacionin e dhënë nga subjekti i të dhënave personale (DHP)

Kjo politikë zbatohet për informacionin e mbledhur në lidhje me:

• Vizitorët paraqesin kërkesa të ndryshme për të marrë informacion për shkak të interesit të tyre për të përfituar nga shërbimet e ofruara nga TV Klan (abonime, etj.) si dhe kur bëjnë ankesa në lidhje me pretendimet e tyre për shkelje të DHP gjatë përpunimit nga kontrolluesi.
• Kandidatët për punësim dhe ish-punonjësit e TV Klan.
• Vizitorët në faqen zyrtare të TV Klan www.tvklan.al; www.klaniim.al;
• Ankuesit që paraqesin ankesa për shkelje të të dhënave të tyre personale gjatë përpunimit nga ana e kontrolluesve.

Abonentët e Klani Im, Ankuesit, kandidatët për punonjës dhe ish-punonjësit

• Abonentët, gjatë vendosjes së marrëdhënies kontraktuale me TV Klan, japin pëlqimin për regjistrimin e DHP të tyre, për përpunimin e mëtejshëm të tyre dhe garantojnë që DHP të përfunduar janë të sakta, të vërteta dhe të përditësuara. Për më tepër, abonentët si subjekte të DHP janë përgjegjës për përditësimin e të dhënave të regjistruara për të siguruar që informacioni të përditësohet vazhdimisht dhe plotësisht. Abonentët e DHP që japin në TV Klan, nënshkruajnë një kontratë me TV Klan, përmes së cilës konfirmojnë miratimin e tyre.
• Kur një person aplikon për punësim pranë TV Klan, ky i fundit përdor informacionin për procesin e përzgjedhjes dhe rekrutimit të tij. • Kur një punonjës nuk është më i punësuar në TV Klan, përgatitet një dosje në lidhje me periudhën gjatë së cilës ai ka qenë i punësuar. DHP që gjendet në të, mbahet i sigurt dhe i përshtatshëm për këtë qëllim, ku aksesi është i kufizuar për çdo person tjetër, përveç Arkivistit dhe Specialistit të BNJ. Këto të dhëna ruhen sipas afatit të përcaktuar me ligj.
• Ankuesi i cili pretendon se ka një problematikë me të dhënat e tij personale.

E drejta e aksesit në DHP

Kërkesa të ndryshme për informacion.

Abonentët si subjekte të DHP kanë të drejtë të kërkojnë akses në të dhënat e tyre dhe të kërkojnë që këto të dhëna të korrigjohen ose përditësohen në përputhje me kërkesat e ligjit 124/2024 “Për mbrojtjen e të dhënave personale”.

TV Klan përpiqet të jetë sa më i hapur për t’i dhënë abonentëve të tij informacionin në të dhënat e tyre personale, veçanërisht për ato raste kur abonentët DHP janë të regjistruar. Ata kanë të drejtë të marrin informacion nëse ne mbahen DHP e tyre duke dërguar një kërkesë me shkrim. Në rast se TV Klan mban DHP, ata do të:

• Jepet një përshkrim i tyre;
• Njoftohet arsyeja pse TV Klan i mban ato;
• Tregon ku dhe kur TV Klan mund t’i shpërndajë këto DHP;
• Një kopje e informacionit jepet në një kopje të kuptueshme;
• Të informuar nëse lëshimi i DHP është i detyrueshëm apo vullnetar.

Për të marrë një informacion të tillë, për çdo DHP që TV Klan mund të mbajë, është e nevojshme të bëhet një kërkesë me shkrim drejtuar kontakteve të publikuara në faqen zyrtare të TV Klan (www.tvklan.al). Për sa më sipër, abonenti njoftohet në momentin e përfundimit të kontratës së blerjes së produktit pasi DHP-të janë dhënë vullnetarisht nga abonenti në momentin e blerjes dhe konfirmohen dhe jepet miratimi me shkrim për to.

Përhapja e DHP

TV Klan garanton se ka marrë të gjitha masat fizike, teknike dhe operacionale për ruajtjen e konfidencialitetit dhe mbrojtjen nga humbja, shkatërrimi, dëmtimi apo shpërndarja e paautorizuar, në përputhje me kërkesat e Ligjit.

Të dhënat personale, të mbledhura dhe të ruajtura në bazën e të dhënave të TV Klan, do të përpunohen nga punonjësit përgjegjës për përpunimin, pasi të jetë dhënë pëlqimi me shkrim nga abonentët në kontratën e blerjes), dhe gjithashtu këto të dhëna nuk do t’i transferohen apo komunikohen të palëve të treta. Palët, përveç rasteve kur është dhënë pëlqimi ose kur ky informacion kërkohet nga autoritetet kompetente me ligj.

Ankuesit

Kur një ankesë paraqitet nga një abonent i TV Klan, ajo regjistrohet në një regjistër të veçantë nga një punonjës përkatës i cili ka nënshkruar më parë deklaratën e konfidencialitetit.

TV Klan përdor DHP që mbledh vetëm për procesin e shqyrtimit të ankesave dhe për të kontrolluar nivelin e shërbimeve që ofron TV Klan. TV Klan përpunon informacionin me qëllim ofrimin e shërbimeve për përdoruesin dhe abonentin. Informacioni është një aset i çmuar. Vazhdimësia e punës së kontrolluesve është e varur në integritetin e tyre dhe disponueshmërinë e vazhdueshme. • Visitors submitting various requests to obtain information due to their interest in benefiting from services offered by TV Klan (subscriptions, etc.) as well as when they make complaints regarding their claims of personal data violations during processing by the controller.

• When a person applies for employment at TV Klan, the latter uses the information for the selection and recruitment process. When TV Klan needs to share personal data with a third party, for example, when TV Klan must verify a reference, or obtain certain data from other relevant institutions, TV Klan does not make such a request without first informing the subjects, obtaining consent only in cases where this information is required by law. Job applicants give prior consent if TV Klan verifies their data. Personal data regarding candidates who are not selected, their documentation is kept for 1 month after application, while CVs are kept for 1 year and then destroyed or deleted.
• When an employee is no longer employed by TV Klan, a file is prepared regarding the period during which they were employed. The personal data contained therein is kept secure and appropriate for this purpose, where access is restricted to any other person, except the Archivist and the HR Specialist. These data are kept according to the legally defined deadline.
